In addition when using KreativAds.com services you as well as KreativAds.com shall abide by all posted guidelines and rules applicable to such Services which may be posted ever so often. All guidelines and rules are hereby incorporated by reference into the P.O.S.

4. PARTNER CONDUCT

YOU AGREE NOT TO USE THE SERVICES TO:

You also agree not to transmit any material which contain software viruses or any other computer code, files and programs design to cause malfunction, or to disable any computer software or hardware or telecommunications equipment.

5. ACCOUNT PASSWORD AND SECURITY

You will receive a password and account number upon completion of the Services registration process. You are responsible for maintaining the confidentiality of the password and the account number, and you are fully responsible for all activities that occur under your password and account. You agree to immediately notify KreativAds.com of any unauthorised use of your password, account number or any other breach of security, and ensure that you exit from your account at the end of each session. KreativAds.com will not be held liable for any loss or damage from your failure to comply with section 5.

10. GENERAL PRACTICES REGARDING USE AND STORAGE

You acknowledge that KreativAds.com may establish general practices and limits concerning use of the Service, including the maximum amount of days that any type of Content can be posted on the Service. You also acknowledge that KreativAds.com reserve the right to log off any account that has been inactive for an extended period of time. You further acknowledge that KreativAds.com reserves the right to change these general practices and limits at any time without advance notice.

12. TERMINATION

You agree that KreativAds.com in it´s sole discretion may terminate your password account, or use of the Service and remove and discard Content within the Service for any reason that KreativAds.com would have to believe that you and or your actions violates the terms of the P.O.S.. You agree that KreativAds.com shall not be liable to you or third-parties for any termination of your access to the Service and that any termination of your access to the Service under any provision of the P. O . S. may be affected without prior notice, and acknowledge and agree that KreativAds.com may immediately deactivate, or delete your account and all related information and files in your account and bar any future access to such files or the Service.

13. CONDUCT WITH ADVERTISERS

Your correspondence, business dealings or participation in promotions of advertisers found on or through the Service including payment and delivery of related goods and services and any other terms and warranties, associated with such dealings are solely between you and the advertiser. You also agree that KreativAds.com shall not be responsible or held liable for any loss or damage of any sort incurred as the result of such dealings or as the result of the presence of such advertisers on the Service.

Because KreativAds.com has no control over such sites and resources, you acknowledge and agree that KreativAds.com is not responsible for the availability of such external sites or resources. For any Content, advertisement, products or other material on or available on such sites or resources, you also acknowledge and agree that KreativAds.com shall not be liable directly or indirectly for any damage caused or allegedly caused by or in connection with use or reliance of such Content, goods or services available on or through any such site or resources.

You acknowledge and agree that the Service and any necessary Software used in connection with the Service contain proprietary and, confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorised by KreativAds.com or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in part or in whole.
KreativAds.com grants you a personal non-transferrable and none-exclusive right and license to use the object code of it´s Software on a single computer, provided that you and no third party copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt, to discover any source code, sell, assign sublicense grant a security interest in, or otherwise transfer any right in the Software, or to modify the Software in any manner or form, or to use modified versions of the Software, including for the purpose of obtaining unauthorised access to the Service.
You agree not to access the Service by any means other than through the interface that is provided by KreativAds.com for use in accessing the Service.

16. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
USE OF THE SERVICE IS AT YOUR OWN RISK AND, PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. KreativAds.com EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, WARRENTS OF MERCHANTABILIT, AND CLAIMS OF ANY KIND WHETHER IMPLIED OR EXPRESSED. KreativAds.com MAKES NO GUARENTEES WHETHER IMPLIED OR EXPRESSED, THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR FREE. THE RESLUTS OBTAINED BY THE USE OF THE SERVICE WILL BE ACCURATE AND RELIABLE AND THAT THE QUALITY OF SERVICE, INFORMATION AND PRODUCTS OBTAINED THROUGH THE SERVICE BY YOU WILL MEET ALL OF YOUR EXPECTATONS AND ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. DOWNLOADED MATERIAL OR MATERIAL OTHERWISE OBTAINED BY YOU THROUGH THE SERVICE IS AT YOUR OWN RISK, AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULT FROM THE DOWNLOADING OF SUCH MATERIAL AND AGREE THAT ANY ADVICE OR INFORTMATION OBTAINED BY YOU FROM "KreativAds.com" OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE "P. 17. LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT KreativAds.com SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM THE USE OR INABILITY TO USE THE SERVICE. YOU ALSO AGREE THAT KreativAds.com WILL NOT BE LIABLE FOR PRODUCTS, SERVICES GOODS, INFORMATION, TRANSACTIONS PURCHASED OR OBTAINED, ENTERDE INTO THROUGH OR FROM THE SERVICE, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSION OR DATA, OR ANY TYPE OF CONDUCT OR STATEMENTS FROM THIRD PARTIES USAGE OF, OR ANY OTHER MATTER RELATING TO THE SERVICE.

18. EXCLUSIONS OF LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR COSEQUENTIAL DAMAGE. ACCORDLINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTION 16 AND 17 MAY NOT APPLY TO YOU.

19. NOTICE

The Service may provide notices of changes in the P. O. S. or other matters by displaying notices or links to notices to you generally on the Service. This will be done either via e-mail or regular mail.

20. TRADEMARK INFORMATION

without the prior permission from KreativAds.com you agree not to display or use in any manner the KreativAds.com marks.

21. COPYRIGHT AND COPYRIGHT AGENTS

KreativAds.com respect the intellectual property of others, and we expect our users to do the same. If you have any reason to believe that your work has been copied in a way that constitutes copyright infringements, please provide KreativAds.com copyright agent with the following information.

1. a description of the copyrighted work that you believe has been infringed.
2. a description of where the material is located on the site.
3. your address, telephone number and e-mail.
4. a statement from you made in good faith that the disputed use is not authorised by the copyright owner, it's agents or the law.
5. a statement from you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorised to act on the behalf of the copyright owner.


22. GENERAL INFORMATION

The P. O. S. constitute the entire agreement between you and KreativAds.com and govern our use of the Service eliminating any prior agreements between you and KreativAds.com. You may also be subject to additional terms and conditions that may apply when you use affiliate services, third party Content and software.
The P. O. S. and the relationship between you and KreativAds.com shall be governed by the laws of the state of Sacramento California. You and KreativAds.com agree to submit to the personal and exclusive jurisdiction of the courts located within the state of Sacramento California.
The failure of KreativAds.com to exercise or enforce any right or provision of the P. O. S. does not constitute a waiver of such right or provision. If any part or provision of the P. O. S. are found under the competent jurisdiction of the courts to be invalid, the parties agree nevertheless that the court shall endeavour to give effect to the parties intentions as reflected in the provisions of the P. O. S. remain in full force and effect.
You agree that regardless of any statute or law to the contrary, any claims or cause of action arising out of or related to the use of the Service or the P. O. S. must be filed within one ( 1 ) year This section titles in the P. O. S. are for convenience only and have no legal or contractual effect.
